In the Consultation Paper, the Law Commission have suggested reforms to encourage the effective use of powers to prevent assets from being dissipated before a confiscation order is made, to ensure that when confiscation orders are made they realistically reflect what a defendant gained from crime, and to improve the enforcement of confiscation orders.

The Law Commission of England and Wales has published its Consultation Paper on "Confiscation of the Proceeds of Crime After Conviction". The Commission has said that it is "deeply indebted to Rudi Fortson QC who has acted as a consultant on this project".
