Jeremy Dein QC succeeds in overturning multiple convictions in the Court of Criminal Appeal

Instructed directly to provide advice on the merits and  thereafter  to conduct an appeal against multiple convictions in relation to possession with intent to supply Class A drugs . 

All of the convictions were quashed following a contested hearing.

The appeal was based on misdirections relating to silence in interview, and failure to give evidence.

In giving judgment, the Court observed that notwithstanding the strength of a prosecution case, such directions were fundamental to a fair trial, that a defendant was entitled to proper legal directions, and that no trial could be fair without them.

The agreement of trial counsel could not be a defence to serious judicial error.  

The Court found there to be “… the greatest force in the Appellant’s submissions”, the convictions were overturned.
