Nicholas Whitehorn
Nick is an experienced and fearless barrister who brings astute tactical acumen and polished advocacy to the most serious criminal cases. He is versatile, and can adapt to whatever circumstances the case demands.
He has for many years now acted as junior alone or leading junior in heavyweight criminal cases, including for defendants charged with conspiracy to murder, attempted murder, high-level and complex fraud cases, Very High Cost Cases (VHCC), serious organised crime and industrial-level importations of class A drugs. From the early stages of Operation Venetic he was instructed to represent numerous defendants alleged to have committed serious offences using the Encrochat network.
He has been described as a ‘natural advocate’, ’superb’ and ‘phenomenal’ by those who instruct him. He is as comfortable making submissions before the Court of Appeal as he is before juries where his speeches have been described as compelling and his cross examination ‘first class’. His understanding and application of the criminal law is excellent, acquired over many years of trial and appellate experience and he is constantly abreast of new developments.
Nick’s extensive experience in criminal appeals includes a number of cases of murder in which he has been instructed as junior alone and has made submissions in the Court of Appeal and in the High Court. Over many years he has been instructed on a private basis to act in appeal cases which have been reported or resulted in successful outcomes notwithstanding the negative advice of originally instructed counsel.
He is fiercely passionate about defending in criminal cases but has an approachable manner and is easily relatable to his clients.
He also has experience of disciplinary law in football and has sat as a panel member for the County FA.
He has written published articles on criminal law and contributed to issues relating to criminal law in magazines, national broadsheet newspapers and on podcasts.
Recent Notable cases
Drugs
- R v Z, Central Criminal Court: Leading junior at first trial of defendant charged with importing cocaine in a case that involved what the NCA described as the largest ever inland seizure of cocaine in the UK; 2 metric tonnes. Defendant was acquitted of firearms offences and jury failed to reach a verdict in respect of the drugs. Media: BBC
- R v P, Isleworth Crown Court: Acted for the principal defendant with alleged multi-national links, including to Columbia, accused of conspiring to import cocaine of 500kg into Belgium and 30kg into South Africa using Encrochat. Nick’s client was described as “one of the biggest drugs traffickers in the UK…”. Case involved complex jurisdictional issues. Legal experts were instructed from Belgium and South Africa on behalf of the defence to support an argument that there should be a significant reduction in sentence. Media: The Sun
- R v TG, Chelmsford Crown Court: Prosecution discontinue conspiracy to import cannabis in response to written application to dismiss
- R v P and others, Loughborough Super Court: silk-led in one of the longest running trials in English criminal history involving a conspiracy to supply class A drugs and firearms: The Guardian
Homicide
- R v S: Silk-led, murder in a dwelling of a cannabis dealer: Independent
- R v C & L: Silk-led in murder of 18 month-old child. Called and cross examined witnesses including toxicology expert from UK and France. Media: ITV
- R v MA: Junior alone. Co-defending with silks on same counts. Client acquitted of conspiracy to murder in gang related shooting in a Kebab shop in North London at the Central Criminal Court. Media: The Sun
- R v Walker, 2019: Appeared for mother accused of conspiring with others to cause the abortion of her child. Case heard by High Court Judge Mr Justice Andrew Baker. Made successful submission of no case to answer at the end of prosecution case. Submissions made including as to the legal definition of ‘miscarriage’. All other defendants were convicted. Fraud
- ‘Operation Barbados’: Leading junior in complex, substantial VHCC £20 million pound VAT fraud for 2nd defendant in trial 4, where all other defendants on the main counts were represented by silk and junior. Media: The Times
- R v JT and others: Silk-led in private prosecution in respect of a multi-million dollar/euro investment fraud where victims were a German scientist and a member of the prominent US family behind the Hasbro toy brand
Appeals
- R v King King [2025] EWCA Crim 596: Instructed on a private basis alongside Kings Counsel for 2 defendants, Father and Son, in an appeal against conviction for murder in which a burglar was stabbed and later died: ITV News
- R v Dhir: Instructed privately to represent defendant in appeal (yet to be heard) against conviction for conspiracy to export cocaine by air to Australia in quantities over 550kg in at least 15 separate flights from the UK. Case received nationwide media coverage: Sky News
