Corporate Criminal Liability for Economic Crime - will the Ministry of Justice take a new approach or extend 'Failure to Prevent'?
The Ministry of Justice is calling for evidence on the best approach to corporate criminal liability and puts forward 5 options. The financial services sector must remain vigilant as the failure to prevent strategy puts a substantial burden on compliance and FCC. As lawyers for the financial services sector, we should be prepared to advise them of their possible liability and how they should protect themselves.
