Colin Wells will be focusing on Human Trafficking and Article 26:

  • Considering the International background: Article 26 the non-punishment provisionof the Council of Europe Convention on Action against Trafficking Human Beings and Article 8 of the EU directive
  • English case law and the CPS Code for Crown Prosecutors, including the Court of Appeal Criminal Division decisions in:
    1. R v Z [2005] 2 AC 467
    2. LM and Others[2010] EWCA Crim 2327 which considered (a) the common law defences of duress and necessity (duress of circumstances) (b) the public policy and evidential basis for a prosecution in a human trafficking context (c) abuse of process as a possible remedy
    3. R v AN (2013) QB 379, [2012] Crim LR 958
    4. R v L, HVN, TH, T v R [2013] EWCA Crim 991
