Ensuring effective participation of vulnerable defendants: a practical guide to fitness to plead and intermediaries.

There is increasing awareness and understanding of the needs of vulnerable defendants. The new regime of better case management requires representatives to be alive to any issues a defendant may have in effectively participating in the proceedings from the outset.

This seminar will provide guidance on:
 
  • Representing defendants with mental health issues or learning difficulties.
  • It will focus on the procedure relating to fitness to plead, instructing intermediaries and practical considerations in the magistrates’, youth and Crown Court. 
  • It will also look forward to the changes that may come following the Law Commission Report on fitness to plead.
